TERMS & CONDITIONS

1. Mental Performance Consulting

Mental performance consulting focuses on helping individuals develop mental, life, and self-regulation skills to improve performance, enjoyment, and personal growth. All of SPC LLCs services use evidence-based strategies to help manage thoughts, emotions, and behaviors related to performance and well-being. Mental performance consulting is not therapy and does not involve diagnosing or treating mental health disorders. 

2. Appointments

Private sessions are 1 hour; sessions may be split into 30-minute meetings if mutually agreed upon. The durations for group/team workshops and programs are determined by the organizational leader and consultant during the initial meeting. Sessions are scheduled by the client through the client portal. Failure to schedule or attend sessions does not remove financial responsibility for the package or program.  

3. Cancellations

Clients may cancel or reschedule sessions through the client portal. If you find that you need to cancel an appointment, please give as much notice as possible so that we can schedule clients who may be waiting for an appointment. No refunds will be provided for canceled sessions/programs.

4. Technology

Virtual sessions take place via Google Meet; other virtual methods are available if mutually agreed upon. If technological issues occur on either end, the session will be rescheduled at no cost. While secure platforms are used, there may be limits to technology security beyond our control.  

5. Communication Between Sessions

If package or program includes ongoing support, the consultant may be contacted via email or the client portal between sessions or workshops. Response time is typically 24–48 hours.  

6. Payment

Payment is required at the time of purchase. Discounts may be offered when applicable. We accept credit and debit card payments. Services are self-pay; insurance is not accepted.

7. Therapy vs. Mental Performance Consulting

Services are provided within a mental performance consulting framework, not a clinical or therapy framework. No mental health diagnoses are made, and services are not a substitute for therapy, counseling, medical, or legal care. Referrals to licensed mental health professionals can be provided upon request.  

8. Client Responsibilities

Clients are responsible for their own decisions, actions, and outcomes. To benefit fully from services, clients agree to communicate honestly, be open to feedback, and actively participate in sessions. 

9. Confidentiality

All information regarding the specific nature of your mental performance sessions or workshops is maintained by Savvy Performance Consulting LLC and is considered confidential unless specified by a client or parent in writing. Information shared virtually or in-person with Savvy Performance Consulting LLC follows the Association for Applied Sport Psychology (AASP) Ethics Code. This relationship is not legally privileged like therapy or legal services. Confidential information may be disclosed if required by law, if there is concern for safety, or if illegal activity is involved.  

10. Records

The consultant may keep notes and records related to services. Records are stored securely, follow ethical guidelines, and remain the property of the consultant.

11. Liability

No specific outcomes or results are guaranteed. Consultant liability is limited to the amount paid for services. 

12. Consent to Consulting

By purchasing services, you confirm that you have read, understand, and agree to the terms above and give consent for mental performance consulting for yourself and/or your family member.

TERMS OF USE

This agreement applies between you, the User of this Website and Savvy Performance Consulting LLC, the owner(s) of this Website. Your agreement to comply with and be bound by the following Clauses of these Terms of Use is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms of Use, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.

In this Agreement the following terms shall have the following meanings:

"Facilities": means collectively any online facilities, tools, services or information that Savvy Performance Consulting LLC makes available through the Website either now or in the future;
"Services": means the services available to you through this Website, specifically use of the Savvy Performance Consulting LLC proprietary e-learning platform;
"Payment Information": means any details required for the purchase of Services from this Website. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;
"Premises": Means Our place(s) of business located at 3000 Green Rd ##131097, Ann Arbor MI 48104;
"System": means any online communications infrastructure that Savvy Performance Consulting LLC makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
"User" / "Users": means any third party that accesses the Website and is not employed by Savvy Performance Consulting LLC and acting in the course of their employment;
"Website": means the website that you are currently using (www.savvyperformanceconsulting.com) and any sub-domains of this site unless expressly excluded by their own terms and conditions; and
"We/Us/Our": means Savvy Performance Consulting LLC, a company incorporated in Michigan, US.

2. Age Restrictions

Persons under the age of 18 should use this Website only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.

  • 3.1 Subject to the exceptions in Clause 5 of these Terms of Use, all Content included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Savvy Performance Consulting LLC, our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable U.S. and International intellectual property and other laws.
  • 3.2 Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given Our express written permission to do so.

  • 4.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.
  • 4.2 Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on the Website or unless given express written permission to do so by the relevant manufacturer or supplier.

5. Fair Use of Intellectual Property

Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

  • 9.1 In order to procure Services on this Website and to use certain other parts of the System, you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as We may not require payment information until you wish to make a purchase.   • 9.1.1 all information you submit is accurate and truthful;

10. Termination and Cancellation of Accounts

  • 10.1 Either Savvy Performance Consulting LLC or you may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons.
  • 10.2 If We terminate your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

11. Privacy

12. How We Use Your Personal Information (Data Protection)

Savvy Performance Consulting LLC uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
  • 15.2 We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

16. Limitation of Liability

  • 16.1 To the maximum extent permitted by law, We accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. 20. Communications

  • 20.1 All notices / communications shall be given to Us by email to sferstle@savvyperformanceconsulting.com. Such notice will be deemed received the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
  • 20.2 We may from time to time, if you opt to receive it, send you information about Our products and/or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from Us.

21. Law and Jurisdiction

These Terms of Use and the relationship between you and Savvy Performance Consulting LLC shall be governed by and construed in accordance with Savvy Performance Consulting LLC and you agree to submit to the exclusive jurisdiction of the United States of America.
